You are responsible for using the Service reasonably, lawfully, and in accordance with this Agreement. The Service is intended for your personal, noncommercial use only. The Service is not for display to groups of individuals or in a classroom setting unless specifically agreed to in writing or you have purchased an Instructor License. You may not authorise others to use the Service. You are responsible for all uses of your account, whether or not authorised by you. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You agree to notify us immediately of any unauthorised use of your account or password. We reserve the right to refuse the Service, terminate accounts, remove, or edit content in our sole discretion.
Description of Service
The Service provides cooking instruction and information via the Internet. We make no guarantee as to the content and content information, including the accuracy, currency, content, success of the recipes or quality of any such content and content information and we assume no responsibility as to whether the Service provides you with your desired results.
The Service(s) provided through the Web site require a fee-based subscription. If you elect to purchase Subscription Services you understand that your subscription is personal to you, and you may not transfer or make available your account name and password to others. Any distribution by you of your account name and password may result in cancellation of your subscription without refund and in additional charges based on unauthorized use. Subscription Services may change, without prior notice. Subscription Services include but are not limited to: (1) access to instructor-guided cooking courses for both a specified period of time. (2) Other Products. Pricing and term will be displayed on the specific product page.
Cancelling Subscription Services
Once you have paid the tuition for the course, 35% of it becomes immediately non-refundable. If you book through a 3rd party, we may already paid their commision fees and charges.
We understand that there are sometimes unfortunate circumstances that are beyond your control that may require you to withdraw from the course (e.g., medical condition or personal emergency). We of course want to be supportive during these situations so will work with you on a one-on-one basis to help. However, after 7-days of the course start, there are no refunds.
You may terminate Subscription of the Services at any time quick and easy in your personal profile or by contacting us. If you have a dispute with us relating to the Web site or the Subscription Services, you may cancel the Subscription of the Services.
Upon any termination or cancellation of your Subscription Services, we may immediately deactivate or delete your Subscription of the Service related features and content.
Prices for all Subscription of the Services included all Australian taxes and charges unless expressly stated otherwise and are in the form of Australian Dollars. If you purchase Subscription Services, you agree to pay, using a valid credit card or another method of payment that we may accept from time to time. If payment cannot be charged to your credit card or your payment is returned to us for any reason, we reserve the right to either suspend or terminate your access to the Paid Subscription Services. You must be 18 years of age or over to purchase a Subscription Service.
You may have access to the Subscription Services for a free trial period. When your free trial period ends, if you wish to continue to use the member and/or subscription-based aspects of the Site, you must subscribe to the Subscription Services. Your free trial will automatically terminate at the end of the trial period. Prior to the end of your free trial period, you may receive information explaining how you can sign up for Subscription Services.
Embedding a Video
(1) You may not embed videos on any website or other location that contains or hosts content that is unlawful, infringing, pornographic, obscene, racially or ethnically offensive, encourages criminal conduct. (2) You may not embed the videos into any hardware or software application, even for non-commercial purposes. We reserve the right to prevent embedding to any website or other location that We find inappropriate.
Intellectual Property Rights
You acknowledge that everything featured or displayed on this Site including, but not limited to text, software, music, sound, photographs, video, graphics, name references, the "look and feel" of the Site content are protected by applicable copyrights, trademarks, service marks, patents, and other proprietary rights and laws. You are permitted to use this Content as expressly authorised by this Agreement. You may not copy, reproduce, rearrange, distribute, transmit, perform, display, or create derivative works of the Content without expressly being authorised to do so in writing by Otao kitchen. You do not acquire ownership rights to any content, document, or other materials viewed through this Site. Some of the content on the site is the copyrighted work of third parties.
Otao kitchen has the right to record all virtual cooking classes for future use on our website and other applications. If you do not wish to be recorded, we recommend you turn your camera off during the class. We may be hosted the classes on different platforms for different types of users.
We may provide links to other web sites or resources. You acknowledge and agree that we are not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on such external sites or resources.
Content Submitted to the Site
We do not claim ownership of the recipes, techniques, or other content you place on this Site. By uploading, submitting or otherwise disclosing or distributing content of any kind on the Site or otherwise through the Service, you: (1) Grant to Otao kitchen and its affiliates worldwide, royalty-free right and license to use, reproduce, display, perform, adapt, modify, distribute, make derivative works of, and otherwise commercially and non-commercially exploit such User Content (2) Represent and warrant to Otao kitchen that you own or otherwise control all rights. (3) Acknowledge that the User Content may not be treated confidentially. (4)You agree not to provide Otao kitchen with any confidential or proprietary information that you desire or are required to keep secret.
We may not accept or consider unsolicited ideas, including ideas for new products, services, technologies, processes, marketing plans, or new product names. Please do not send any original artwork, samples, demos, or other works. If you do send such materials, we make no assurances that your ideas and materials will be treated as confidential or proprietary. Any feedback you provide on this Site will be deemed non-confidential and non-ownership.
Waiver of Liability
You agree that the use of this Service is at your sole risk. The service is provided on an "as is" and "as available" basis. We assume no responsibility for the timeliness, deletion, misdelivery, or failure to store any of your personalisation settings. Otao kitchen shall not be liable for direct and indirect damages resulting in the use of this Site. You agree not to resell the Service. Otao kitchen retains the right to determine this Agreement and may terminate your Service any time with or without refund of the Service.

You agree: (1) to comply with Australian law and applicable international law regarding (2) only legal use of transmission of technical data and the use of the Service; (3) not to use the Service for illegal purposes; (5) not to interfere or disrupt networks connected to the Service; (6) to comply with all regulations, policies and procedures of networks connected to the Service, (7) not to post or transmit through the Service any harmful material of any kind or nature, (8) not to post any material constituting junk mail, or unauthorised advertising, commercial offers, invades anyone's privacy or encourages conduct that could constitute a criminal offence, (9) responsible for ensuring that any material you provide not to violate the copyright, trademark, trade secret, or any other personal, moral, or proprietary rights of any third party, (10) not to disrupt, overwhelm, attack, modify or interfere with the Service or its associated software and agree not to alter or tamper with any information or materials on or associated with the Service, (11) not to have any children under the age of 16 use, submit or post any information to the site without a parent or guardian's consent.
You agree to indemnify and hold Otao Kitchen, its parent, subsidiaries, affiliates, officers, and employees, harmless from any claim or demand, including reasonable lawyer' fees, made by any third party due to or arising out of your use of the Service, the violation of this Agreement by you, or the infringement by you, or other users of the Service using your computer, of any intellectual property or other rights of any person or entity.
All communications to shall be made either via email. We may broadcast notices or messages through the Service to inform you of changes to this Agreement, the Service, or other matters of importance; such broadcasts shall constitute notice to you.
This Agreement shall be interpreted, construed and governed by the laws of the Victoria, Australia, without reference to its laws relating to conflicts of law. Venue for all disputes arising under this Agreement shall lie exclusively in a court in Victoria, Australia In addition, both parties agree to submit to the exclusive personal jurisdiction and venue of such courts. Otao Kitchen shall have the right to commence and prosecute any legal or equitable action or proceeding before any non-Australia court of competent jurisdiction to obtain injunctive or other relief in the event that such action is necessary or desirable.
Otao Kitchen makes no representation of any kind that all content, materials, and services on the Site are appropriate or available for use in all geographic locations, especially some locations outside of Australia, and accessing such from certain locations may be illegal and prohibited.
